Terms of purchase

When you place an order, you enter into a binding agreement with Florea Seeds AB (hereinafter ‘Florea’) and must provide the necessary information, contact information and payment information in order for us to fulfil our obligations to you as a customer. Remember that it is your responsibility to ensure that the information is correct. Florea cannot be held responsible for any delays or problems that arise as a result of incorrect or incomplete information provided by you.

Upon receipt of your order, a confirmation e-mail will be automatically sent with information about the order. Florea disclaims responsibility for delivery in cases where the stock balance was incorrect at the time of your order. If Florea cannot deliver according to the order confirmation, you will be contacted by e-mail. To shop at flo-rea.com you must be at least 18 years old.

When you order from us, you also accept the terms and conditions for payment via Klarna and delivery with UPS, DHL and PostNord as below:

Terms Klarna

By using Klarna, you agree to Klarna AB (publ)’s (556737-0431, Sveavägen 46, 111 34 Stockholm), “Klarna”, terms and conditions as set out below, including any appendices or other material referred to (the “Terms”). By entering or requesting information, you start using Klarna. By doing so, you have also authorised our processing of your personal data, including the possibility for us to transfer the data to third parties or for processing outside the EU/EEA area. To use Klarna, you must be at least 15 years old.

Identification, customisation and risk assessment

In order to securely identify you and prevent unauthorised use or abuse of Klarna and to meet the requirements of good credit granting practice, Klarna needs to ensure your identity. Klarna collects additional information such as social security number, name and address and, when choosing credit options, credit information from various suppliers. Klarna also needs to use the information you may have provided in previous purchases, publicly available information on the internet and information about how you have previously fulfilled our payment terms, to make a risk assessment. Klarna automatically adapts the risk assessment, and thus the design of the service, each time you use the service and you do not need to provide more information than necessary. In some cases, the address previously provided and approved by Klarna will be displayed to you as soon as you provide your email address and postcode. The authorised address may only be used for the purpose of pre-filling the address details in direct connection with a purchase. You can easily avoid pre-filling the authorised address by choosing to apply a PIN code. By finalising the purchase, you confirm your identity and correct delivery address.

Payment, fees

Klarna presents the payment options that can be offered to you. Current payment options that may currently be offered through Klarna are invoice, instalment or card payment. Invoice is the default payment option where possible. When paying by invoice, Klarna’s current invoice terms apply; currently 30 days credit, a reminder fee will be added in the event of non-payment. If you have purchased for less than SEK 60, SEK 29.00 will be added, and if you have purchased for SEK 60 or more, SEK 60.00 will be added as a reminder fee. There is also a penalty interest rate corresponding to 24% plus the reference rate set by the Riksbank from time to time. There is no cost to use Klarna. However, any taxes or fees may be added by the chosen payment option, see the individual payment terms for the option you choose. Klarna may add or remove one or more payment options from those offered in Klarna at any time.

For most payment methods, when you finalise a purchase via Klarna, you and Klarna enter into an agreement whereby Klarna guarantees, among other things, that you will not have to pay if you do not receive your goods. At the same time, Klarna reimburses the shop for what you have purchased and thus assumes the right to be paid. Regardless of which payment method you choose, your payment goes to settle the claim Klarna has. However, you may be offered other payment methods in Klarna (such as Swish), where Klarna does not take over the claim from the store, but your payment of the debt is instead settled directly to the seller. However, your purchase will still be covered by Klarna’s buyer protection in these cases.

Usage

Klarna is the holder of all rights to Klarna. As a user, you may only use the service in the intended way to make purchases, until further notice and in accordance with the applicable Terms and Conditions. If you have previously shopped with Klarna and thereby provided your address, your address will be automatically pre-filled as soon as you enter your e-mail address and postcode. You can opt out of this feature at any time by sending an email to dataskydd@klarna.se or by selecting that option directly in Klarna.

Declaration

You declare that the information you provide is correct and yours, and that you may enter into contracts freely and without the authorisation of a guardian, trustee or other person.

If you are using the Service on behalf of a legal entity, you also warrant that you are authorised to enter into this Agreement and hereby accept the Terms in their entirety on behalf of that legal entity. By providing personal data about other persons, you also confirm that you have authorised the provision of such data and that the data may be used for the purposes and in the ways described in these Terms.

Misuse

Use of information that is not yours or that you are otherwise not authorised to use, as well as use of Klarna in any other way that is not intended, will be deemed by Klarna to be misuse. All information related to misuse or suspected misuse of Klarna, for example by providing incorrect or misleading information, is saved and used for future risk assessments and to protect the parties involved. The user may be blocked from further use of Klarna. Your compliance with the Terms and Conditions and individual payment terms for Klarna’s services also affects the risk assessment when using Klarna and thus your ability to use all payment options.

Personal data

Klarna and its partners process your personal data in order to be able to offer you a simplified payment via Klarna and to be able to further simplify the payment process the next time you use Klarna’s services. Klarna processes the personal data for the purpose of ensuring your identity, administering the customer relationship, preventing misuse or incorrect use of payment services, performing customer analyses, credit assessment, risk analyses, risk management, business development, for commercial and marketing purposes for itself and for our specially selected partners, and to comply with applicable legal requirements in general. Personal data is any information that can be directly or indirectly linked to you.

The following are examples of personal data that Klarna processes:

  • Contact information – name, address, e-mail address, telephone number etc.
  • Social security number
  • Payment information – card number, invoice information, etc.
  • Financial information – e.g. information about income and any payment remarks (used in cases where a credit report is taken)
  • Item information – information regarding the purchases you make
  • Historical information – details of previous purchases, how you have complied with payment terms in the past, any refusals, etc.
  • Information about your computer/device – IP address, language settings, browser settings, etc.
  • Publicly available information on the internet

Social security numbers are used for identification and as customer numbers for customer management purposes in Klarna’s system. If you have previously used Klarna, there may be saved information about you for, for example, customer management, documentation requirements or similar authorised purposes. Klarna will use any such information to ensure your identity and simplify your use of Klarna. Klarna may also use electronic communication (communication via e.g. SMS and e-mail) in its contacts with you. Klarna may disclose information to other companies within the Klarna group of companies, which may also use the information in the ways and for the purposes described here. For administrative purposes, data may also be disclosed to the e-retailer where you made your purchase and to our specially selected partners for customer analysis and marketing. Furthermore, data may be disclosed in connection with the transfer of a claim to a debt collection agency or equivalent. The data may also be transferred for processing outside the EU/EEA area to a state that does not have the same level of protection for personal data. Klarna is committed to the protection of personal data and will implement appropriate safeguards to protect the data. You have the right to request access to the data concerning you in writing once a year. You also have the right to correct inaccurate data and to opt out of receiving further marketing communications. Klarna is the data controller for the processing of your personal data.

Changes, additions and other Services

Klarna is constantly changing and improving the services and reserves the right to change the Terms for the continued use of Klarna. Therefore, always read the Terms before each new purchase. For other services provided by Klarna, Klarna’s terms and conditions and price list for such services apply from time to time. The terms and conditions and price list are available at www.klarna.se. If it turns out that a particular term is not enforceable, this shall not affect any other terms.

Links to or from other websites

Klarna does not endorse or control any third party website or application and we are not responsible or liable in any way for their content. To the extent you use such third party site or application, the terms of that site/application apply.

Limitation of liability, applicable law and disputes

In addition to what follows from the Terms and Conditions or mandatory consumer law legislation, Klarna is in no case responsible for damage caused directly or indirectly by the use of Klarna. Nor is Klarna liable for any damage caused by the customer’s failure to comply with the PIN code provisions. Swedish law applies and any disputes shall be handled by the general court.

Cancellation

The right for you to use Klarna remains until cancelled by either party. Such termination has immediate effect but does not affect the terms and obligations for completed purchases (unpaid invoices, fees, etc.) or the right to process personal data in the manner described above.

We are proud that all our shipping is 100% climate compensated and that all seeds come packed in 100% plastic-free recyclable material.

We deliver to your home with PostNord, DHL and UPS. We ship working days Monday to Friday and the normal delivery time is 2-4 working days from receiving your order.

Delivery time

Parcels within the EU (outside of Sweden) are normally delivered within 2-4 working days (excluding public holidays).

Pre-purchase and instalment delivery

All pre-purchase orders are paid for directly at the time of purchase and delivered at a later date when the goods are in stock. If you order more products in the same order and wish to have them delivered directly, you can choose to deliver your order in instalments at the checkout.

Delay in delivery

We do our best to deliver as quickly as possible, but unfortunately delays sometimes occur. We therefore do not guarantee delivery on a specific day and always reserve the right to delays.

Right of return

Here we want to be generous and offer you 30 days open purchase. We understand that you may regret it and that is perfectly OK. If you want to return your order, contact us at help@flo-rea.com and we will help you. Please note that the goods must be in their original condition and an opened seed bag cannot be returned.

Complaints

According to the Consumer Purchase Act, you as a private person have the right to complain about a product for 3 years after you have received it. If you want to complain about your product, contact us directly at help@flo-rea.com and we will help you. You must complain about the product ‘within a reasonable time’ after you have discovered the defect and the defect must be ‘original’, that is, it was already there when you received the product. If your complaint is accepted, we will pay for the return shipping and transport risk, and depending on the nature of the fault, we will repair or replace the goods, or offer a credit. Thirdly, financial compensation is received, which cannot exceed the sales value of the goods. In the event of a dispute, we always follow the decision of the General Complaints Board.

Information in the webshop

We at Florea work actively to avoid errors in the webshop. However, there may be errors and incompleteness in information, texts, images, graphics and other material. In such cases and to the extent permitted by law, we cannot be held liable for any damage arising therefrom, unless such damage is the result of gross negligence or wilful misconduct on our part.

It is always our intention to accurately and fairly represent the goods for sale in this webshop. However, we cannot guarantee that the colours on the product pages accurately reflect the true colours of the goods. Any discrepancies may be due to your computer’s colour and image settings and therefore we cannot guarantee that the colours are exactly the same as on your computer screen.

All plants are unique, therefore we cannot guarantee that the plant you buy will look exactly like the pictures, however we can promise that we will do our best to send you a plant that is as similar as possible.

We reserve the right to remove or change the services and products we offer and the information we display on our webshop at any time and for any reason without prior notice.

Goods that are out of stock

If an item you ordered is out of stock, your other items will be dispatched as soon as possible. We will always contact you as soon as possible to inform you if any item is missing from your order. We will also credit your payment for the missing item within 14 days. We do not backorder temporarily out-of-stock items and we reserve the right to make mistakes in our webshop. Items that are temporarily out of stock must be re-ordered at another time. We are unable to automatically notify you when an item is available again after being temporarily out of stock.

Prices on flo-rea.com

All prices on flo-rea.com are in EUR and include VAT. Prices are valid until further notice. For products included in various campaigns, prices are only valid during the campaign period. We reserve the right to make price errors and price changes due to changes in VAT, abnormal changes in the currency situation, purchase prices, as well as changes in or the existence of new statutory fees. In the event of obviously incorrectly priced goods, Florea reserves the right to cancel the order.

Consumer law

As a consumer in Sweden, you always have the right to contact us directly at Florea for help with complaints, right of cancellation and other help regarding purchases or orders.
